Klein's Blood Alcohol Level .07%, DA Will Not File Criminal Charges

District Attorney says Andy Klein's blood alcohol test results showed the San Carlos vice mayor at a .07%, below the legal limit.

District Attorney Steve Wagstaffe said Tuesday that criminal charges will not be filed against San Carlos Vice Mayor Andy Klein regarding his for suspicion of driving under the influence. 

The results, Wagstaffe said, showed Klein's blood alcohol level to be .07 percent. The state of California's legal limit is 0.08 percent.

"Our decision not to file charges is based on this test result, the absence of any observed driving, Mr. Klein's performance on the field sobriety tests and the absence of any unequivocal signs of impairment to drive," said Wagstaffe.  "We have notified the California Highway Patrol of our non-filing decision this morning."
