Sentencing Date Postponed for Hallmark Roofing Couple

John and Camille Applegate pleaded nolo contendre (no contest) to eight felony counts in July; their sentencing date has been moved to Oct. 24.

The owners of Belmont-based Hallmark Roofing were granted a continuance on sentencing Tuesday in San Mateo County Superior Court by Judge Mark Forcum.

On July 31, 2012, John and Camille Applegate pleaded nolo contendre (no contest) to eight felony counts stemming from insurance and workers' compensation premium fraud.

San Mateo County District Attorney Steve Wagstaffe said the Applegates made a motion to continue the sentencing because their home is currently in escrow, telling the judge they will use the proceeds from the sale of the home to pay the restitution to the State State Compensation Insurance Fund and Employment Development Department.

"Judge Forcum granted the defense motion to continue and reset the case for both defendants to Oct. 24, 2012 9:00 a.m. for imposition of sentence and for restitution hearing," said Wagstaffe in an email.

The maximum sentence promised by the court was three years imprisonment; the district attorney has requested seven years imprisonment.

The Applegates are former spouses who remained business partners in their company, Hallmark Roofing. for allegedly failing to report employee wages and not paying workers' compensation premiums from 2007-2011.

A forensic audit by the state Department of Insurance determined the Applegates did not pay hundreds of thousands of dollars in insurance premiums, allowing their company to make lower bids on projects than their competitors.

The couple also failed to file tax returns in both 2010 and 2011, according to the District Attorney’s Office. If convicted, they could each face up to five years in prison each and fines in excess of $1 million, according to the state Department of Insurance.

The defendants are out of custody on $50,000 bail bond.

Not to say that they should not pay for their crimes....but in yesterday's patch....two young men were convicted of multiple robberies...using a gun.....and they got about one year in prison. In what world is violent crimes (multiple) using a weapon that can kill less serious than not filing and paying taxes?????? .......

Al Capone was imprisoned for tax evasion. Seems the govt. is determined to get their money even though they piss it away once they get it.

I think the key here is that they created a competitive advantage stealing work from legitimate contractors. Their comepetitors were providing comprehensive bids and losing the work. This results in people losing their jobs and even their businesses.
They deserve what they get. As for as other crimes - they deserve more.

People like this is why we have so many roofing contractors feeling they need to break the law to allow them to make competitive roofing bids. Extremely unfortunate, I have a roofing business MCAS Roofing www.westchesternyroofers.com and I am licensed, insured, and bonded. It is difficult for me to compete because of people like this and I hope they get the maximum sentence!

I agree with everything that's been said here. I think what's upsetting is the mild punishment for armed robbery.

I also preferred the 'old' Patch - this format makes it difficult to find articles that are aren'tRead More that old. One example was the informative article on who was running for city Council. I was having problems finding it and finally had to query on a candidate's name to find. I don't recall having that issue with the original format. Also our neighborhood had a water break line and we were without water for some hours a few Sundays ago. I tried to find out the reason for the break (because of construction or old pipes?) and could not find anything on the Patch regarding this. Not sure if they just didn't report or I just couldn't find.

Hi Don....thanks for your question. Yes, Off the Grid does pay a licensing fee to the city, and soRead More far, we haven't heard any concerns by local restaurants. The food trucks provide an option to a traditional restaurant---pick up and go----and they are only around 4-5 hours per week (on Mondays, typically not a big restaurant night anyway). Have you tried the food yet?
