Burglars Nabbed in Hallmark Neighborhood Plead Not Guilty

The three suspects were arrested after they allegedly broke into a home in San Mateo, then led police on a pursuit that prompted the lockdown of Fox Elementary and Ralston Middle schools in Belmont.

Three men suspected of breaking into a San Mateo home then leading officers on a pursuit through neighboring Peninsula cities, ending on Rinconada Court in Belmont, pleaded not guilty in San Mateo County Superior Court on Tuesday.

Alert residents in Belmont and San Mateo helped police track down and arrest Oakland residents; 21-year-old Dalton Tubby, 22-year-old Jorge Nervaez and 20-year-old Marquise Weaver; on March 7 after the multi-city pursuit that prompted the lockdown of two Belmont schools.

The incident began when police responded to a report of the sound of a front door breaking at a residence in the first block of Lakewood Circle in San Mateo at about 10:20 a.m., Sgt. Dave Norris said.

Officers quickly arrived at the scene and based on detailed reports by witnesses, began a lookout for a gold, four-door car with a dark gray trim fleeing the area, Norris said.

Police located the car on U.S. Highway 101 and pursued it off the highway and onto Holly Street in San Carlos, according to Norris.

After evading police again, the car was spotted by Belmont police in the area of El Camino Real and Ralston Avenue, Norris said.

With the assistance of a San Mateo County sheriff's detective, Belmont police pursued the car through the hills of Belmont and onto Rinconada Court, Norris said.

The three suspects exited the car, one with a handgun, and fled the area, according to the police sergeant.

Calls from community members helped police keep tab of the suspects' whereabouts and a short period later, all three suspects were safely taken into custody, Norris said.

The pursuit ended at about 11:20 a.m., he said.

No shots were fired in the course of the incident. One officer suffered a minor injury in a crash during the pursuit, he said.

Nearby Fox Elementary and Ralston Middle schools were locked down briefly during the pursuit, Norris said.

All three suspects were booked into the San Mateo County Jail on suspicion of conspiracy, burglary, possession of stolen property, and resisting or obstructing arrest, police said.

Tubby was additionally booked for felony fleeing from the police, felony resisting arrest due to injury of an officer, parole violation, brandishing a handgun at an officer, and multiple charges related to being an armed and prohibited violent felon.

Nervaez was additionally booked for felony fleeing from the police, and for being a driver allowing a passenger to carry a loaded firearm, police said.

All three defendants pleaded not guilty to the charges Wednesday and did not waive their rights to a speedy trial.

The case was set for jury trial on May 13, with a pretrial conference on May 6.

Nevarez remains in custody in lieu of $100,000 bail, Tubby remains in custody in lieu of $250,000 bail, and Weaver is out of custody on a $50,000 bail bond.

San Mateo police are continuing to investigate the burglary.
